Does Unused Annual Leave Automatically Expire? Not Always.

Many employees believe that if they do not take their annual leave before the end of the leave year, they automatically lose it.
This is often because their contract of employment states that annual leave cannot be carried forward into the following year.
However, the legal position is not always that straightforward.
What Does the Law Say?
Every employee is entitled to a minimum level of paid annual leave under the Organisation of Working Time Act 1997, which gives effect to the EU Working Time Directive.
While employers can generally require employees to take their leave within a particular leave year, simply including a "use it or lose it" clause in a contract does not necessarily mean an employee loses their statutory annual leave.
The key question is whether the employer took reasonable steps to ensure the employee could actually take that leave.
The Employer's Responsibility
European case law has made it clear that employers cannot simply remain silent and later argue that the employee chose not to take their leave.
An employer should be able to demonstrate that it:
- Gave the employee a genuine opportunity to take their statutory annual leave.
- Encouraged the employee to take that leave.
- Made the employee aware that failing to take it could result in the entitlement being lost.
If those steps were not taken, an employee may argue that their statutory annual leave did not automatically expire, even where the contract appears to prohibit carry-over.
Every Situation Is Different
This does not mean that every employee can automatically recover years of untaken annual leave.
Whether leave can be carried forward or recovered will depend on the individual circumstances, including:
- the terms of the contract of employment;
- whether the leave related to statutory or additional contractual leave;
- what information the employer provided about annual leave;
- whether the employer genuinely facilitated the employee taking their leave; and
- the applicable statutory time limits for bringing any legal claim.
Each case must be assessed on its own facts.
